The Application & Website, “Housie Math Fantasy and/or Housie.live” (“hereinafter referred to as “App and/or Website”) in all of its forms is owned and operated by Buckyballs Infotech Pvt. Ltd.(hereinafter referred to as “Company”). By downloading, installing, browsing, accessing, or using this App, you agree to abide by and be bound by the Terms and Conditions (defined herein below) of the App.

These Terms of Service (“Terms/Agreement”) govern your use of this App and anywhere else where these Terms are posted for rendering Services of the App (collectively “Services”). These Terms of Service apply whether you are accessing the Services using a mobile device. These Terms of Service do not cover other services, apps or any content, features and activities accessible or made available by any third party, unless specifically stated. BY ACCESSING AND USING THE SERVICES OF THIS APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE LEGALLY BOUND BY THESE TERMS, WHICH ARE INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS AND ANY AMENDMENTS THERETO, YOU MUST NOT USE THIS APPLICATION’S SERVICES.

Buckyballs Infotech Pvt. Ltd.reserves the right to modify the Terms of Service contained herein and the terms and conditions of our Privacy Policyand/or any other agreements and Disclaimer without any prior notification. You are advised to regularly review these Terms of Service and such other terms and conditions mentioned hereinabove.

Unless otherwise specified herein, these Terms of Service constitute the entire Agreement between the user and the App with respect to the App’s Services and it supersedes all prior or contemporaneous communications and / or proposals, whether electronic, oral or written, between the user and the App with respect to the App’s Services.

The Terms of Service contained herein along with the Privacy Policy and any other terms and conditions related to the App form an Agreement regulating our relationship with regard to the use of the App by you. PLEASE READ THIS AGREEMENT CAREFULLY. This Agreement is effective upon your due completion of the online registration process on the App. Accordingly; you confirm your acceptance of the Terms. If you do not agree with any of the Terms and Conditions mentioned herein and /or with the Privacy Policy of this App, you shall NOT be granted the rights to access and use of the Services and shall not access any of its Services.

The App may electronically block or otherwise deny access to the App, to any user deemed to be in violation of any of the terms in this Agreement.

If a promotion, game, event, competition or tournament is organized by Private Limited Firm on the App, it shall be governed by the Terms and any supplementary terms and conditions which may be specifically applied for that promotion, game, event, competition or tournament.

This App is fully entitled to assign all its rights and obligations hereunder, to a successor to all or any of its assets, whether by sale, merger or otherwise, without any hindrance. These Terms shall be binding upon and shall insure to the benefit of the parties hereto and their respective representatives, heirs, administrators, successors and permitted assigns except as otherwise provided herein.

This Agreement between you and us shall be subject to following Terms and Conditions:-

Definitions:

The terms not defined herein shall have the meaning assigned to it in the Privacy Policy. The terms wherever used shall unless contrary, carry the meaning as given under:

“Agreement” means this Terms of Service, the Terms and Conditions contained herein along with any Privacy Policy of any other portals whose links are provided from this App. It shall also include reference to this Agreement as and when amended, novated, supplemented, varied or replaced.
“user/You/Your/s” means and includes any person who visits and / or uses the App to avail the Services to play the skill-based games offered by the App.
“Portal” means mobile applications through which the games are offered.
“Product/Products” connotes the Services provided on the App.
“Terms and Conditions” means the terms and conditions contained herein.

Terms:

The user certifies that he/she is at least 18 (eighteen) years of age. Any user who is “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. is not eligible to enter into this Agreement with App.
The user agrees that the user is not accessing the Services to play the games in India from the States of Assam, Orissa, Sikkim, Nagaland, and Telangana and outside India from any state or country which prohibits such kind of Services offered by us including games of skills. Prior to adding cash to your user account or participating in cash games, you shall be responsible to satisfy yourself about the legality of playing cash games in the jurisdiction from where you are accessing cash games. If you are not legally competent to individually enter into Indian Rupee transactions through banking channels in India, you are prohibited from participating in cash games on the App. In the event of such violation, your participation in cash games will be deemed to be in breach of the Terms and you will not be entitled to receive any prize that you might win in such cash games. Any participation by such user shall be at their sole risk and discretion and the App and /or any person related to the App shall not be liable to refund or reimburse any injury or damages suffered by such individuals.
You shall not hold us responsible for not being able to play any game for which you may be eligible to participate. This includes but is not limited to situations where you are unable to log into your user account as your user account may be pending validation or you may be suspected or established violation of any of the Terms.
You agree to provide authentic and true information. This App reserves the right to confirm and validate the information and other details provided by the user at any point of time. If upon confirmation such user details are found not to be true (wholly or partly), this App has the right in its sole discretion to reject the registration and debar the user from using the Services the App without prior intimation whatsoever.
You are aware that participation in the games organized by us may result in financial loss to you. With full knowledge of the facts and circumstances surrounding your activity by participation in the games organized by us, you are voluntarily participating in this activity and assume all responsibility for and risk resulting from your participation, including all risk of financial loss. You agree to indemnify and hold us, our employees, directors, officers, and agents harmless with respect to any and all claims and costs associated with your participation in the games organized by us.
You represent that you have the experience and the requisite skills required to participate in the game organized by us and that you are not aware of any physical or mental condition that would impair your capability to fully participate in the game. You further acknowledge that you are solely responsible for any consequence resulting from you participating in the game organized by us or being associated with this activity or around this activity. You understand that we assume no liability or responsibility for any financial loss that you may sustain as a result of participation in the game.
You understand and accept that your participation in a game available on the App does not create any obligation on us to give you a prize. Your winning of a prize is entirely dependent on your skill as a player vis-a-vis other players in the game and subject to the rules of the game. You understand that the funds in your user account held by us do not carry any interest or return.
The information, Products, and Services displayed through this App may include inaccuracies or typographical errors. Additionally, a possibility exists that unauthorized additions, deletions and alterations could be made by third parties to the App. Although this App attempts to ensure the integrity and the accuracy of the information, Products, and Services displayed on it, it makes no guarantees whatsoever as to the correctness or accuracy of the Products / Services / schemes displayed on App and their quality. In the event that such an inaccuracy arises, please inform the App by emailing at [email protected] so that it can be corrected, if possible.
We do not control or take responsibility / liability as regards the truth or accuracy of contents posted or control the safety, or legality of the items advertised therein by us. You may find other users, information or advertisements posted to be offensive, harmful, inaccurate or deceptive. This App is and shall not at any point of time be responsible for the contents of the information or advertisements posted on this App. The opinion / advice expressed on this App are not those of this App, and any errors or omissions in them belong to the respective contributors / persons giving such opinion. Through the use of this App, you agree to hold and save harmless and indemnified the App and its sponsors, owners, shareholders or employees, etc. against any and all claims related to the opinions expressed by others or Products bought and sold on this App.
The remainder of this document covers the specific terms and conditions under which, each major Service category of this App is provided for your use. It is your responsibility to make sure you read and understand this document, before using any App’s Services. Please do not contribute to this App in any manner unless and until you have carefully read, understood and agree with all of these terms.

This App has not personally verified the authenticity of the information / opinion given by you.
You truthfully assert that you have not given false, wrong / incomplete information.
This App shall not be responsible or liable for loss if visitors to the App violate the Terms and Conditions and download and print your information, content/s, opinion/s, etc. without your permission.
You grant us the right to collate and store your personal details and data, given by you, on your own account on the App.

Except where permitted by law or relevant open source licenses, you will not modify, reverse engineer, decompile, disassemble, decipher or otherwise try to derive the source code for the App. Further, You will not reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the App, or to obtain any information from the App using any method not expressly permitted by the App;
Violate any applicable local, state or national, including but not limited to, any rules of any national or other securities exchange, including, without limitation and any regulations having the force of law;
“Stalk” or otherwise harass, threaten or bully any another user; Collect or store personal data about other users either manually or by means of automated software tools; Promote illegal activities; inhibit other users from using and enjoying the unedited forums.
Post classifieds advertisements that contain untruthful representations, deceptive practices, inducements to commit any illegal activity.
Use this App for unlawful purposes.
You will not attempt to gain unauthorized access to the App, to accounts registered to others, or to networks from which portions of the App are provided, including by circumventing or bypassing robot exclusion headers or security mechanisms for the App.
You will not make any automated use of the App, or take any action that imposes an unreasonable burden on our infrastructure.
You will not improperly use our support services, including by submitting false reports.
Create any user account by automated means or false pretences, create more than one account per device, or use any other user account(s) for any purpose, including to circumvent a suspension or ban.
You will comply with your obligations to third-party mobile platform providers, such as Apple, Android and Google, from whom you download the App, including any terms regarding payment for In-App Purchases made through such platforms.
If We detect any activity from Your user Account that is fraudulent, suspected to be defrauding the App, or if You are found colluding or participating in any kind of fraudulent activity on the App in any manner, then You shall be debarred from participating in any Contest available on the App.
We reserve the right to deactivate or delete Your Account and all related information on it and forfeit related Balances and/or take any other appropriate action, at our sole and absolute discretion, in the event of any fraudulent, illegal or suspicious activities from Your Account on the App.
You agree to keep this App, and its owners, developers and any person associated with this App, indemnified and saved harmless at all times in respect of any liability (Civil/Criminal and/ or Financial) arising out of any such unlawful acts on your part and/ or upon violation of these terms and conditions.
You will not advocate, promote, encourage, or otherwise facilitate any illegal behaviour, including but not limited to the use of illegal drugs, unlawful gambling or theft, communal hatred and terrorism.

Failure to comply with this Code of Conduct may result in the suspension of your account, or any portion of your account, and/or subject you to any of the penalties identified under Indemnity Clause mentioned herein below in this Agreement.

Using the App’s Services:

This Section covers the terms under which various App Services, including, but not limited to, link forwarding Services, event information, opinion/opinions and any information available on this App, are made available to you.

The rules applicable to each type of games offered by us are provided under the “How to Play” section in the App.

The App provides cash games. The cash games require the participant to have a certain minimum balance in their “wallet”, that is a part of the user account provided by the App.

This App deducts 10% charge of every ticket which has been purchased in the game for operational and maintenance of platform/website/App.

User Registration:

This App requires registration for those who participate in its Services / facilities.

When you register as this App’s user in any manner, you accept the following terms and conditions:

The App provides the platform to You on which You can play HOUSIE LIVE. The platform is designed to provide You an in-app browsing experience through an embedded browserrun online over the platform and have to be separately downloaded or installed from respective online stores eg. App Store, Play Store.
You may register by approving and agreeing to this Agreement and providing Your registered mobile phone number and email ID on the platform. You will be verified by ususing a one-time password (“OTP”) system. Upon successfully verifying the OTP, an account will be created for You (“Account”).
The user of such other facilities agree to provide true, accurate, current and complete information as required in the registration form.
You agree to maintain and promptly update the registration or subscription data as necessary to keep it true, accurate, current and complete.
Your Account is for Your personal use only. You shall not impersonate someone else. By creating an Account after providing a mobile phone number and verifying it using an OTP, You represent, warrant, and agree that You are authorized to use the platform and will abide by the Agreement.
Each user is wholly responsible for maintaining the confidentiality of his / her account login and password information and for all activities occurring thereunder. The App cannot and will not be liable for any loss or damage arising from a user’s failure to comply with the confidentiality clause, including any loss or damage arising from any user’s failure to:
Immediately notify the App of any unauthorized use of his or her password or account or any other breach of security and
Ensure that he or she exits or logs out from his or her account at the end of each session.
Your account is for your personal use only. You specifically agree not to: (1) share your account credentials with anyone else, (2) sell, offer to sell, rent, lease, trade or otherwise transfer your account.
The App reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by a third party that a username violates the third party’s rights.

It is entirely possible that you may not be able to access your user account or the Services provided by this App at times or for extended periods of time due to, but not limited to, system maintenance and updates.

This App makes no representations or warranties of any kind, express or implied, as to the operation of the app or the information, contents, materials on the app, including that:

The App will be uninterrupted, timely, secure error-free or free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.
The acts or omissions of the infrastructure providers or otherwise failure of internet services used for providing and accessing the Services.

Errors in the software will be corrected.

Your sole remedy for dissatisfaction with the App, App-related services and / or content or information contained within the app is to stop using the app and / or its services.

Any games played by you on the App and any material downloaded or otherwise obtained through the use of this App is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the do.

You agree to indemnify, defend and hold this App, harmless from all claims, damages and expenses (including attorney’s fees) made by any third party arising out of your content; your use of this App; your use, abuse or misuse of your user account on our App in any manner whatsoever; your connection to this App; your violation of this Agreement; our Terms or our Privacy Policy; and the development; operation; maintenance; infringement of their intellectual property rights by your publication of any content on our App, defamatory, offensive or illegal conduct of any other player or for anything that turns out to be misleading, inaccurate, defamatory, threatening, obscene or otherwise illegal whether originating from another player or otherwise; any disconnections, technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data or communication lines failure, distributed denial of service attacks, viruses or any other adverse technological occurrences arising in connection with your access to or use of the App; access of your user account by any other person accessing the Services using your username or password, whether or not with your authorization.

Limitation of Liability:

IN NO EVENT SHALL THE APP, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, PERSONAL INJURY/ WRONGFUL DEATH, OR DAMAGES RESULTING FROM LOST DATA OR INTERRUPTION) WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF INCOME, LOSS OF OPPORTUNITY, DAMAGE TO PROPERTY, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

THE USE OR THE INABILITY TO USE OUR SERVICES OR ACCESS CONTENT; OR
THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM TRANSACTIONS ENTERED INTO THROUGH OR FROM THIS APP; OR
THE DEFAMATORY, UNDESIRABLE OR ILLEGAL CONDUCT OF ANY OTHER USER OF THE SERVICES INCLUDING STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR
THE UNAUTHORIZED ACCESS TO OR ALTERATIONS OF YOUR TRANSMISSIONS OR DATA AND ANY LOSS INCURRED IN TRANSMITTING INFORMATION FROM OR TO US OR FROM OR TO OUR APP BY THE INTERNET OR BY OTHER CONNECTING MEDIA; OR
THE ACCURACY, COMPLETENESS OR CURRENCY OF ANY INFORMATION SERVICES PROVIDED ON THE WEBSITES AND APPS; OR
ANY TECHNICAL FAILURES, BREAKDOWNS, DEFECTS, DELAYS, INTERRUPTIONS, IMPROPER OR MANIPULATED DATA TRANSMISSION, DATA LOSS OR CORRUPTION OR COMMUNICATIONS’ INFRASTRUCTURE FAILURE, VIRUSES OR ANY OTHER ADVERSE TECHNOLOGICAL OCCURRENCES ARISING IN CONNECTION WITH YOUR ACCESS TO OR USE OF OUR SERVICES; OR
ANY OTHER MATTER RELATING TO THE SERVICE, EVEN IF THE APP HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

THIS APP’S MAXIMUM AGGREGATE LIABILITY WITH THIS AGREEMENT, IN RESPECT OF ALL SERVICE PROVIDED AND ALL TRANSACTIONS UNDERTAKEN BY THE USERS BY USING THE SERVICES SHALL BE LIMITED TO AN AMOUNT EQUAL TO THE FEES, PAID BY YOU TO THE APP. THESE LIMITATIONS AND EXCLUSIONS APPLY EVEN IF THIS REMEDY DOESN’T FULLY COMPENSATE YOU FOR ANY LOSSES OR FAILS OF ITS ESSENTIAL PURPOSE OR IF WE KNEW OR SHOULD HAVE KNOWN ABOUT THE POSSIBILITY OF THE DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESE LIMITATIONS AND EXCLUSIONS APPLY TO ANYTHING OR ANY CLAIMS RELATED TO THESE TERMS, THE SERVICES, OR THE SOFTWARE RELATED TO THE SERVICES

Void Where Prohibited:

Although this App is accessible pan India, not all Products or Services discussed or referenced on this App are available to all persons or in all geographic locations or jurisdictions. This App reserves the right to limit the provision of any Product or Service to any person, geographic area or jurisdiction as per the applicable laws and as it so desires in its sole discretion and to limit the quantities of any such Product or Service that it provides. Any offer for any game or Service made on this App is void where prohibited.

Payments and Financial Transactions:

We maintain a user account for you to keep a record of all your transactions with us your registration on the App.
In order to participate in the games, the users is required to buy a ticket. Payments connected with participation in cash games have to be made through your “wallet” in the user account. users may add money to the housie wallet by using any of the payment modes available on the App. All cash prizes won by you are credited by us into this housie wallet.
Cash won by you can be used to buy tickets to play further games and /or alternatively may be withdrawn by you.
All transactions on the App shall be in Indian Rupees.
While making a payment, please ensure that the instrument used to make the payment is your own and is used to add cash into your housie wallet only.
Subject to the limits of cash to be added in the housie wallet specified by us from time to time, you are free to deposit as much money as you want in your housie wallet for the purpose of participating in cash games on the App.
If you make any financial transactions on this App, including paying for Services fees, playing games, you may be asked for credit card or other payment information. You agree that all information you provide is accurate, complete and current and that you will pay all charges owed, including any applicable taxes. You agree that you are solely responsible for any personal income reporting and tax payments required of you by applicable government authorities. The payments are processed through third-party payment gateways. We are not responsible for delays or denials at their end and processing of payments will be solely in terms of their policies and procedures without any responsibility or risk at our end. If there are any issues in connection with adding or withdrawing cash, a complaint may be sent to us at [email protected]. You agree that in such an event of your credit being delayed or eventually declined for reasons beyond our control, we will not be held liable in any manner whatsoever. Once a payment/transaction is authorized, the funds are credited to your housie wallet and are available for you to play cash games.
We have the right to cancel a transaction at any point of time solely according to our discretion in which case if the payment is successful, then the transaction will be reversed.
We are obliged to permit maximum withdrawal of Rs. 9,000/-(Rupees Nine Thousand Only) in a single game. In these cases, you will be required to furnish your Permanent Account Number (PAN) duly issued to you by the Income Tax authorities if you have not already done so.
We reserve the right to verify your PAN from time to time and to cancel any prize should your PAN be found inconsistent in our verification process.

Withdrawals:

You may withdraw your winnings by means of electronic bank to bank transfer for the amount of winnings. The winning amount will be transferred within 15 working days.
Users are eligible to withdraw only cash winnings from his / her account to his / her respective bank account once it is KYC (Know Your Customer) verified. KYC verification is mandatory as a proof of identity for making withdrawals from your housie wallet to bank account. For KYC and withdrawal verification we will require your PAN card details, email id, government ID card and other user details.
To be eligible to win a cash prize, you must be a resident of India and accessing the Services from India.
If you are a cash winner resident in India and physically present in India while accessing the Services but not an Indian citizen, we will remit your cash winnings in Indian Rupees to the address/bank account given by you, provided, the address and bank account are within India.
Any charges which the bank levies for the transactions will be applied to the withdrawals to be made by the winners.

Return , Refund or Cancellation:

We do not have a cancellation and refund policy, however the users are requested to email us at [email protected] for any issues pertaining to any return, refund or cancellation. The support team and the management will look in to the grievance of the users and in case the reasons are genuine and proved after investigation the user will be contacted via email for return or refund within 15 working days.

Termination:

A user may choose to close their account in the App by following the procedure of closing of account in the App and / or contacting customer service at [email protected] section on the Platform, by email.
On closing of the account, the users who wish to recover funds held in a closed, locked or excluded account are advised to contact Customer Service at [email protected].

This App reserves the right to discontinue in whole or part any portion of this App’s Services or programs with or without notice if the management of this App believes that you have violated the letter or spirit of this Agreement/ any Terms of Service. Ending the App or use of this App does not terminate your Agreement. WE MAY, IN OUR SOLE DISCRETION, LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE APP OR ANY PORTION OF IT, AND PROHIBIT ACCESS TO THE APP AND THE CONTENT, SERVICES AND TOOLS AVAILABLE THROUGH THE APP, OR DELAY OR REMOVE USER CONTENT, AND WE ARE UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY LOSSES OR RESULTS.

Upon termination of your account for any reason, you agree to no longer access (or attempt to access) the App.

Notice:

Notices by us to You will be provided on the email you provide to us during the registration process (in your case). Notice through e-mails shall be deemed given within three (3) days after an e-mail is sent unless the sending party is notified that the email address is invalid.

Waiver:

In case in the failure of this App to enforce or to exercise at any time or for any period any term of or any right pursuant to these Terms of Services shall not be construed as a waiver of any such right and shall in no way affect this App’s right later to enforce or exercise it.

Third-Party Merchants and Advertisers:

You acknowledge that App does not control the performance of merchants or advertisers that appear on this App. Therefore, if you choose to purchase a product or service by the merchants or advertisers appearing on the App, you release us from any and all claims you may have regarding the third party’s failure to deliver or perform as agreed.

Independent Investigation:

You acknowledge that you have read this Agreement and agree to all its terms and conditions. You understand that we may at any time (directly or indirectly) solicit member referrals on terms that may differ from those contained in this Agreement. You have independently evaluated the desirability of participating or using in this App or its programs and /or features and are not relying on any representation, guarantee or statements other than as set forth in this agreement.
